Major non-compliance criteria

There are nine major non-compliance criteria for each of the activities we regulate under the Environmental Authorisation (Scotland) Regulations (EASR):

These are the activities that will be included first in the Environmental Performance Assessment Scheme (EPAS).  In future, we will develop major non-compliance criteria for other activities that we regulate to be included in EPAS. When we check compliance, we inform authorisation holders whether they are compliant, non-compliant or major non-compliant with their authorisation.

The major non-compliance criteria are grouped into the following key areas:

  1. Major impact of the authorised activity.
  2. Scope of site.
  3. Understanding of authorised activities.
  4. Overall management of authorised activities.
  5. Wider legal environmental requirements and financial non-compliance.
