New sewage discharge from less than or equal to 10 domestic properties or 50 population equivalent
There are eight activities covered by the new discharge of sewage effluent description. The full description of a new discharge of sewage effluent is as follows:
- Less than, or equal to, 10 domestic properties.
- Non-domestic properties with a population equivalent of less than, or equal to, 50.
- A combination of both domestic and non-domestic properties with a total population equivalent of less than, or equal to, 50
Where the discharge is not within a phosphate sensitive catchment or directly to a freshwater loch.
There are 8 activities covered by this overarching description.
Authorisation level
Registration
Standard conditions
If you carry out an activity under a registration authorisation you must comply with the standard conditions. It is an offence if you do not comply with the conditions.
SEPA will not authorise this activity if it poses an unacceptable risk to the environment.
Discharges to soakaway
Activity description
The discharge of sewage from:
- less than or equal to 3 domestic properties; or
- non-domestic properties with a total population equivalent of less than or equal to 15; or
- a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 15;
to full soakaway where:
- the soil percolation value is more than 15 seconds per millimetre; and
- the soakaway is not within a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated:
- by a septic tank; or
- to a standard that is better than that provided by a septic tank.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- The discharge must not be directly into groundwater.
- The soakaway must be located 50 metres or more from any spring, well or borehole that supplies water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
Activity description
The discharge of sewage from:
- more than 3 but less than or equal to 10 domestic properties; or
- non-domestic properties with a population equivalent of more than 15 but less than or equal to 50; or
- a combination of both domestic and non-domestic properties with a total population equivalent of more than 15 but less than or equal to 50;
to full soakaway where:
- the soil percolation value is more than 15 seconds per millimetre; and
- the soakaway is not within a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated:
- by a secondary treatment system; or
- to a standard that is better than that provided by a secondary treatment system.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- The discharge must not:
- be directly into groundwater; or
- have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The soakaway must be located 50 metres or more from any spring, well or borehole that supplies water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
Activity description
The discharge of sewage from:
- less than or equal to 10 domestic properties;
- non-domestic properties with a population equivalent of less than or equal to 50; or
- a combination of both domestic and non-domestic properties with a total population equivalent of less than or equal to 50;
to full soakaway where:
- the soil percolation value is less than or equal to 15 seconds per millimetre; and
- the soakaway is not within a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated by a treatment system that is designed to meet a mean standard of no more than 5 milligrams of ammoniacal nitrogen (as nitrogen) per litre (mg/l) of sewage effluent.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- The discharge must not:
- be directly into groundwater; or
- have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The soakaway must have a minimum area in square metres (m2) of:
- 15 multiplied by the total number of domestic properties; or
- 3 multiplied by the total population equivalent of all the non-domestic properties; or
- 3 multiplied by the total population equivalent where there is a discharge from a combination of both domestic and non-domestic properties.
- The soakaway must be located 50 metres or more from any spring, well or borehole that supplies water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
Discharges to watercourses
Activity description
The discharge of sewage from:
- less than or equal to 3 domestic properties; or
- non-domestic properties with a total population equivalent of less than or equal to 15; or
- a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 15;
to a watercourse that provides a high amount of dilution and is outside:
- a zone to protect shellfish waters;
- a zone to protect bathing waters; or
- a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated;
- by a septic tank and a partial soakaway; or
- by a secondary treatment system; or
- to a standard that is better than that provided by a secondary treatment system.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- Any partial soakaway must have a high level overflow.
- Any partial soakaway must have a minimum area in square metres (m2) of;
- 25 multiplied by the total number of domestic properties; or
- 5 multiplied by the total population equivalent for all non-domestic properties; or
- 5 multiplied by the total population equivalent where there is discharge from a combination of both domestic and non-domestic properties.
- The discharge must not have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1, 2, 3 and 4, do not take effect until 12 months after the date the authorisation was granted.
Activity description
The discharge of sewage from:
- less than or equal to 10 domestic properties; or
- non-domestic properties with a population equivalent less than or equal to 50; or
- a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 50;
to a watercourse that provides a:
- high amount of dilution for discharges from between 4 and 10 domestic properties or between 16 and 50 population equivalent; or
- medium amount of dilution for discharges from up to 10 domestic properties or up to 50 population equivalent;
and where the watercourse is outside:
- a zone to protect shellfish waters;
- a zone to protect bathing waters; or
- a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated:
- by a secondary treatment system; or
- to a standard that is better than that provided by a secondary treatment system.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- The discharge must not have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1 and 2 do not take effect until 12 months after the date the authorisation was granted.
Activity description
The discharge of sewage from:
(i) less than or equal to 10 domestic properties; or
(ii) non-domestic properties with a population equivalent less than or equal to 50; or
(iii) a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 50;
to a watercourse that provides a low amount of dilution and is outside:
(i) a zone to protect shellfish waters;
(ii) a zone to protect bathing waters; or
(iii) a phosphate sensitive catchment.
Standard conditions
- The sewage must be treated:
- by a secondary treatment system; or
- to a standard that is better than that provided by a secondary treatment system;
and a partial soakaway.
- The treatment system must be maintained so that it is fully functioning except during any period when maintenance work is being carried out to the system.
- The partial soakaway must have a high level overflow.
- The partial soakaway must have a minimum area in square metres (m2) of:
- 10 multiplied by the total number of domestic properties; or
- 2 multiplied by the total population equivalent for all non-domestic properties; or
- 2 multiplied by the total population equivalent where there is discharge from a combination of both domestic and non-domestic properties.
- The discharge must not have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1, 2, 3 and 4 do not take effect until 12 months after the date the authorisation was granted.
Activity description

For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1, 2, 3 and 4 do not take effect until 12 months after the date the authorisation was granted.
Discharges to coastal and transitional waters
Activity description
The discharge of sewage from:
- less than or equal to 10 domestic properties; or
- non-domestic properties with a population equivalent of less than or equal to 50; or
- a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 50;
to coastal or transitional waters outside a zone to protect:
- shellfish waters; or
- bathing waters
Standard conditions
- The sewage must be treated:
- by a septic tank; or
- to a standard that is better than that provided by a septic tank.
- The treatment system and outfall pipe must be maintained so that they are fully functioning except during any period when maintenance work is being carried out.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1 and 2 do not take effect until 12 months after the date the authorisation was granted.
Discharges near bathing and shellfish waters
Activity description
The discharge of sewage from:
- less than or equal to 10 domestic properties; or
- non-domestic properties with a population equivalent of less than or equal to 50; or
- a combination of domestic and non-domestic properties with a total population equivalent of less than or equal to 50;
to a watercourse, coastal or transitional waters within a zone to protect:
- shellfish waters; or
- bathing waters.
Standard conditions
- The sewage must be treated:
- by a system that is designed to meet no more than 500 Escherichia coli per 100 millilitres of sewage effluent and 200 intestinal enterococci per 100 millilitres of sewage effluent; or
- by a secondary treatment system and a proprietary filtration system using bio-fibrous media.
- The treatment system and outfall pipe must be maintained so that they are fully functioning except during any period when maintenance work is being carried out.
- The discharge must not have a significant impact on any supply of water for human consumption that was in existence on the date of application for this authorisation.
- The discharge must not have a significant impact on the water environment as a result of:
- iridescence or sheen;
- discolouration;
- deposition of solids;
- increased foaming; or
- microbiological growth.
For the discharge of untreated sewage, the following condition will be included:
- If the sewage has been discharging to the water environment for more than two years, without treatment, on the date of application for this authorisation, conditions 1 and 2 do not take effect until 12 months after the date the authorisation was granted.
How to apply
You can apply for these activities on our online private sewage application service from the 1 November 2025. The application process and the conditions that will be applied will be very similar to the current process and conditions applied under The Water Environment (Controlled Activities) (Scotland) Regulations (CAR). Our online application services will be modified for The Environmental Authorisations (Scotland) Regulations 2018 (EASR) and will allow you to identify which activity you are and the treatment that your discharge requires.
