Who can hold an authorisation

When you apply for a permit or registration under the Environmental Authorisations Regulations (Scotland) 2018, SEPA will assess whether you are:

  • The person who will have control over the regulated activity.
  • A fit and proper person to be in control of the regulated activity.

The test of being ‘in control’ is the same for all authorisations. The fit and proper person test will be carried out differently for different activities, reflecting the individual risks. 

Fit and Proper Person tests

The overall purpose of the assessment is consistent across all regulated activities, but how we apply the assessment criteria depends on the specific activity. Where we have information to suggest that a particular applicant may need a more detailed assessment, we may apply the criteria differently. This is because the test evaluates both the environmental risk of the activity and the applicant’s attitude toward compliance.

We take several criteria into account when deciding if a person is fit and proper. This can include:

  • Compliance history.
  • Relevant convictions.
  • Technical competence.
  • Financial provision.
  • Any other relevant criteria.

If you are applying for an authorisation where evidence is normally required to demonstrate the applicant has a particular qualification or expertise, or that adequate financial provision is in place, this will be set out on the activity specific web page.
